Whitpain Resident Withdraws Request to Have Charges Dismissed

Whitpain resident, Kate Kelly, has withdrawn her request to have DUI-related charges dismissed.

Kate M. Kelly, a Montgomery County Criminal defense lawyer, and a resident of Yorkshire Drive in Whitpain, has withdrawn her request to have a DUI-related charge dismissed, according to a report in the Ambler Gazette.

The charges are in relation to a May 2009 vehicle accident in East Norriton.

According to the Gazette article, Kelly filed papers in May seeking a dismissal of the case arguing that according to Pennsylvania’s Rule 600, authorities “have 365 days from the date the criminal complaint was filed to bring the defendant to trial.”

Prosecutors are calling the claim “baseless.”

“According to court documents, Kelly is now scheduled for a 'non-trial disposition' hearing later this month on charges in connection with the alleged May 21, 2009, DUI incident at Township Line and Whitehall roads in East Norriton, as well as a second alleged DUI-related incident Nov. 29, 2010, in the 1700 block of Markley Street in Norristown, during which Kelly allegedly collided with a SEPTA bus," according to the Gazette article.
